Liability Waiver
Please read the following terms carefully. By participating in any class provided by Hustle & Flow (the Instructor) you consent to, and agree to release the Instructor from liability according to, these terms. Unless the Instructor notifies you otherwise, this waiver and release will apply to all classes undertaken by you with the Instructor.
You acknowledge that:
you are over 16 years of age;
you understand that the classes are a form of physical activity and that there are inherent risks in undertaking any form of physical exercise;
you have disclosed, or will disclose to the Instructor prior to the class commencing, any pre-existing conditions that may place you at a higher risk of injury or inhibit your ability to participate in a class, this includes, but is not limited to:
injuries, pain or recent surgery;
pregnancy or if you have recently given birth; or
respiratory or heart conditions or high blood pressure.
you will notify the Instructor if you experience any pain throughout the class and will immediately stop participating in the class if requested by the Instructor to do so;
based on information you provide, the Instructor may decide not to allow you to participate in a class, or may require you to provide a medical certificate affirming that you are able to participate in a class before allowing you to join, in the Instructor’s sole discretion;
recommendations or instruction provided by the Instructor may not be tailored for your particular skill or ability level and it is your responsibility to assess whether you are able or want to participate in all or part of a class;
you are solely responsible for ensuring that your physical environment is suitable for your participation in any class; and
classes may be recorded for by the Instructor for quality control, as well as promotional purposes. If you do not consent to the Instructor using video or still images taken during the class for promotional purposes, please notify the Instructor in writing.
To the extent permitted at law, you release and hold the Instructor (and where applicable its, directors, employees and representatives) harmless from any liability, cost, expense, damages or claims (including claims of negligence) arising from or which may be suffered or incurred in connection with your participation in any classes provided by the Instructor.
Cancellation Policy
If you cancel within a 12 hour period from the start of your booked class you will be charged for that class. We understand that cancellations are sometimes unavoidable and this policy is not in place to punish cancellations but rather to give all customers the best opportunity to attend class.

PAYMENTS:
Memberships: the client will complete a direct debit authority online, and select a preferred membership. The funds will be deducted from the nominated bank account every week.
Class packs: the client will purchase online using a debit or credit card and select the preferred class pack. The client acknowledges that the class pack begins from the date of first booking, and acknowledges the specified time frame they must use the class pack within.
The client acknowledges that for class packs and memberships only, their class credit will be refunded back to their account if they cancel their class before the 12 hour cancellation period.
The client acknowledges that our casual classes are non-refundable after purchase. Once purchased a casual class, it will remain valid on your account for one year unless booked.
The client agrees to pay all applicable fees by the due date. If a payment is dishonoured, the client will be notified and will have 3 days to remedy the default.
Failure to make a payment may result in a late payment fee from Hustle & Flow. Hustle & Flow will not take responsibility for any charges from the bank because of a late payment.
MEMBERSHIP HOLDS:
Hustle & Flow does not offer open ended holds. The client is to complete a hold form that will state a start and finish date, or provide the start and finish date in an email to Hustle & Flow via the following email <info@hustleandflow.nz>. After this date, the client's payment plan will continue as per their payment plan schedule.
The client may freeze their membership for the following periods depending on their membership type:
6-month membership: The client may freeze their membership for a maximum of period of 4 weeks over the 6 month term
12-month membership: The client may freeze their membership for a maximum period of 6 weeks per year.
At least 1 week's written notice is required for membership pause suspensions. This ensures that the correct measures are put in place to cease direct debit payments that are scheduled for the given period. Written notice must be given via email. Note: social media communications are not a valid method of pausing membership.
MEMBERSHIP OPTIONS
All memberships are billed on a weekly basis, and classes will be allocated over that week and must be used within that week. It is the members responsibility to know their billing cycle dates and therefore book their membership classes within these dates. This information can be found in the profile section on the MindBody app.
All 2 class/week membership options give the client access to up to 2 classes over the members specific weekly billing period. If the client does not use the allocated 2 classes during the week, these credits will expire and the client cannot use them in subsequent weeks.
All 3 class/week membership options give the client access to up to 3 classes over the members specific weekly billing period. If the client does not use the allocated 3 classes during the week, these classes will expire and the client cannot use them in subsequent weeks.
If the client chooses a fixed-term membership option, the contract cannot be cancelled until expiry unless due to injury or illness. In these circumstances a medical certificate must be provided.
All memberships operate on a 7 day direct debit schedule via MindBody/Ezidebit (a secure system). Payment will continue unless notified of a termination request in writing (see Termination Policy below).
The client will not be refunded under any membership option for not using their weekly allocated classes.
Classes are not transferable to another individual and cannot be used by another person. If someone other than the person booked into the class arrives to use the session, they will be asked to create an account and purchase their own classes or membership.
Membership fees and other fees are reviewed periodically. Hustle & Flow may amend these Terms and Conditions at any time by written notice published on their website, operable from the date specified. The client will be given 14 days' notice of any changes to the members email provided.
The client acknowledges and agrees that passes are not refundable, extendable, or transferable unless otherwise agreed by Hustle & Flow.
It is at the discretion of Hustle & Flow whether they run classes, if any, on public holidays.
There will be no classes running over the Christmas season, all memberships will be frozen over this period. The length of time will be at the discretion of Hustle & Flow. This freeze period will not be included in the 4 week membership freeze period allowed per membership term.
The client agrees to pay the below membership price, applicable to their selected membership:
2 class/week 6-month membership: $48/week
2 class/week 12-month membership $44/week
3 class/week 6-month membership: $72/week
3 class/week 12-month membership: $66/week
Casual drop in classes are $35/class. The client must book prior to attending to ensure there is space available in the class.
5 class pass is $150 and must be used within 2 months of their first booked class.
10 class pass is $280 and must be used within 3 months of their first booked class.
20 class pass is $500 and must be used within 6 months of their first booked class.
Intro Offer is 4 classes for $60 and must be used within 14 days of their first booked class. The Intro Offer is only available to brand new clients. This offer is non refundable and non transferable. This offer can only be used once per customer.
MEMBERSHIP CANCELLATIONS
The following cancellation policies apply to each membership. Fixed term contracts only allow cancellation due to illness/injury or extreme circumstances. It is important that clients select a membership that best suits their needs.
The client is to complete a cancellation form or email their cancellation notice to <info@hustleandflow.nz>.
6-month: Cancellation only allowed due to injury/illness or extreme circumstances. A medical note must be provided.
12-month: Cancellation only allowed due to injury/illness or extreme circumstances. A medical note must be provided.
BOOKING CLASSES
It is important that the client follows booking rules and etiquette.
The client is to book their space in the class online, either via the Hustle & Flow website, or via the MindBody App.
If the client has to cancel their class, they will do so online also. If the client cancels within the class cancellation window, their class will not be credited back to their account.
Hustle & Flow has small and intimate classes, so it is very important that clients are considerate of booking etiquette so fellow members do not miss out on classes.
Cancellation windows are subject to change at the discretion of Hustle & Flow.
If the schedule shows “waitlist”, this means the class is currently full.
You can add yourself to the waitlist and if there is a cancellation earlier than 12 hours before the start time of your booked class, the first person on the waitlist will automatically be added to the class and be notified via email.
If there is a cancellation within 12 hours of the start time of class, the system will not automatically assume you would like to be added to the class, given such short notice. Instead you will receive a message from us to check if you would like to be added to the class.
Payment must be made prior to booking. To book into a class you must either have pre-purchased sessions on your account or pay at the time of booking in the studio.
By booking into a class you automatically agree to these Terms and Conditions

It is very important that members respect our class cancellation windows. Our classes are small and intimate, and we want to give everyone equal opportunity to get their weekly classes in!
Memberships and class packs: Cancellations made more than 12 hours before the class start time will get the class credit back.
Memberships and class packs: Cancellations made less than 12 hours prior to class start time will forfeit that session. No shows and absences will forfeit that session.
GENERAL
Out of consideration for the trainer and other clients, please don’t be late. If you are more than 5 minutes late for class, your spot may be given to a waitlisted or stand-by client and your class will be non refundable.
Late arrivals may be denied entry at the discretion of the trainer.
Gift cards can be used for classes. They are not redeemable for cash and are non transferable. Hustle & Flow does not offer refunds, transfers, suspensions or extensions on Gift Cards or packs for any reason.
First timers attending their first class must arrive at least 5-10 minutes before the scheduled start time so the trainer can familiarise them with the reformer.
Classes are not transferable to another individual and cannot be used by another person. If someone other than the person booked into the class arrives to use the session, they will be asked to create an account and purchase their own classes or membership.
If the minimum number of clients per class is not met, Hustle & Flow reserves the right to cancel the class. The studio will contact booked clients in the case of a class cancellation.
Trainers and classes are subject to change without notice.
The minimum age for participating in a Hustle & Flow Reformer class is 16 years. Exceptions on a case-by-case may apply.
Should you contract a disease of an infectious or contagious nature, please consult your doctor to ensure you are fit to attend your next class and are not at risk of infecting others. This is for the safety and well-being of all our clients and staff.
PRIVACY
The client agrees that Hustle & Flow may collect, store and use your personal information. Any personal information will only be accessible by Hustle & Flow staff primarily in the interest of ensuring our clients health and wellbeing.
INDEMNITY
Hustle & Flow shall NOT be liable or responsible for any direct, indirect, or consequential injury, loss or damage to the person or the property of any participant at Hustle & Flow Reformer Pilates, one off training events, one-one training products or any other service of a similar nature.
All personal property is the responsibility of the individual and Hustle & Flow accepts no liability for any loss or damage. Cubby holes are available for when the client is training, items left for longer than the client's session will be placed into the lost property and eventually discarded if not collected.
PHOTOGRAPHY
Classes may be recorded by the Instructor for quality control, as well as promotional purposes. If you do not consent to the Instructor using video or still images taken during the class for promotional purposes, please notify the Instructor in writing.
All signatories to this agreement give permission for Hustle & Flow or any licensed provider to use their image for marketing purposes.
